2. Object

These General Terms of Use (GTU) define the rules for accessing and using the Diane AI website (https://diane.app) and the services offered.

Use of the Site implies full and complete acceptance of these T&Cs.

3. Access to the service

3.1 Registration

  • Registration is free
  • User must be at least 16 years old (or 13 years old with parental consent)
  • The information provided must be accurate and up to date
  • Each user can only create one account

3.2 Identifiers

  • The user is responsible for maintaining the confidentiality of their login details.
  • Any use of the account will be deemed to have been made by the account holder
  • In case of fraudulent use, the user must inform us immediately

4. User Obligations

The user agrees to:

  • Provide accurate information and keep it up to date
  • Do not impersonate another person
  • Do not use the Site for any illegal or unauthorized purpose.
  • Do not distribute content that is illegal, offensive, defamatory or infringes the rights of third parties
  • Do not disrupt the operation of the Site
  • Respect intellectual property rights
  • The user retains ownership of the content he creates via the application (notes, flashcards, etc.), but grants TCH a non-exclusive and worldwide license to host, display and process them within the framework of the service.

5. Intellectual Property

All elements of the Site (texts, images, logos, videos, structure, etc.) are protected by copyright, trademark law and/or any other intellectual property right.

Any reproduction, representation, modification or unauthorized exploitation is strictly prohibited.

6. Liability

6.1 Limitation of liability

We make every effort to ensure the availability and security of the Site, but cannot guarantee:

  • Uninterrupted access to the Site
  • The absence of errors or bugs
  • Absolute security of transmitted data

6.2 Force majeure

We cannot be held responsible in the event of force majeure or events beyond our control.

7. Termination

7.1 By the user

The user can stop their subscription or delete their account at any time from the settings. Or via the App Store or the Play Store if the subscription was taken out on one of these platforms.

7.2 By us

We reserve the right to suspend or delete an account in the event of:

  • Failure to comply with these T&Cs
  • Fraudulent use
  • Harmful behavior

8. Modifications to the T&Cs

We reserve the right to modify these Terms of Use at any time. Users will be informed of any substantial changes on the website https://diane.app.

Continued use of the Site after modification constitutes acceptance of the new T&Cs.

9. Applicable law and jurisdiction

These T&Cs are subject to Swiss law. In the event of a dispute, and after an attempt at amicable resolution, the courts of the canton of Neuchâtel shall have sole jurisdiction.
